General Terms & Conditions
These Terms & Conditions apply to the use of the BuildVolume website and to purchases made from the applicable BuildVolume entity.
Nothing in these Terms & Conditions excludes, restricts or limits any right or remedy that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008 ("CPA"), the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), the Protection of Personal Information Act 4 of 2013 ("POPIA"), or any other applicable South African law.
1. WHO YOU ARE CONTRACTING WITH
"BuildVolume" is a trading name used by more than one South African company.
The legal entity with which you contract depends on the relevant sales channel, store, stock location and the entity identified on your quotation, sales order, order confirmation or tax invoice.

References in these Terms to "BuildVolume", "we", "us" or "our" mean the applicable BuildVolume contracting entity for the relevant transaction unless the context specifically refers to the Website operator or another named entity.
Online Store and Linked-Company Stock
The BuildVolume Online Store is operated by B Volume (Pty) Ltd t/a BuildVolume.
However, our Online Store may display stock held by or available from linked BuildVolume companies and stores.
Where you select a linked company or store as the supplying, collection or fulfilment location, that linked company may be the seller for that transaction.
For example, where you select BuildVolume JHB Store, the applicable seller may be BuildVolume JHB (Pty) Ltd t/a BuildVolume.
The applicable legal entity will be identified by the selected store/location and/or on the relevant quotation, sales order, order confirmation or tax invoice.
2. ACCEPTANCE OF THESE TERMS
These Terms apply to your use of our Website and purchases from the applicable BuildVolume entity unless a separate written agreement expressly applies.
By placing an order, creating an account, accepting a quotation or continuing to use the Website, you agree to these Terms to the extent permitted by law.
Where you qualify as a consumer under the CPA, these Terms must be interpreted consistently with the CPA and nothing contained herein waives a consumer right that cannot lawfully be waived.
Online transactions are additionally subject to ECTA where applicable.
3. ELECTRONIC CONTRACTING AND ORDERS
3.1 Shopping Carts and Wishlists
Adding a product to a shopping cart, wishlist or quote request does not reserve stock and does not constitute an agreement of sale.
3.2 Formation of a Sale
Unless BuildVolume expressly agrees otherwise, a sale is concluded when BuildVolume accepts your order and payment has been authorised or received.
Where approved credit terms apply, a sale is concluded when BuildVolume confirms acceptance of the order.
3.3 Review and Correction
Before submitting an online order, customers must be given a reasonable opportunity to review the transaction, correct mistakes and withdraw from the transaction before final placement, as contemplated by ECTA.
3.4 Order Refusal or Cancellation
BuildVolume may lawfully refuse or cancel an order due to:
-
suspected fraud;
-
payment failure;
-
obvious pricing or system errors;
-
stock errors;
-
sanctions or export restrictions;
-
inability to lawfully supply the product; or
-
another legitimate and lawful reason.
If BuildVolume cancels an order after receiving payment and no goods are supplied, the amount paid for the cancelled goods will be refunded.
3.5 Transaction Records
BuildVolume will retain transaction records for the periods required by applicable law and its legitimate record-keeping obligations.
Customers should retain invoices, proof of purchase and product serial numbers.
4. PRODUCTS, PRICING AND STOCK
4.1 Product Information
BuildVolume takes reasonable steps to ensure that product descriptions, specifications and images are accurate.
Images may be illustrative and manufacturers may make minor changes to packaging, colours, firmware, bundled items or specifications without materially changing the core functionality of the product.
4.2 Stock Availability
All stock is subject to availability and may change without notice.
If goods become unavailable after payment, BuildVolume may offer:
-
an appropriate alternative;
-
a back-order arrangement; or
-
a refund.
Any applicable statutory consumer rights remain unaffected.
4.3 Pricing
Prices will be displayed as indicated on the relevant product page or quotation.
South African consumer-facing prices will include VAT where required.
Business quotations may state VAT separately.
Delivery, installation, training, duties or other charges are additional unless expressly included.
4.4 Pricing Errors
BuildVolume takes reasonable steps to ensure pricing is accurate.
BuildVolume is not obliged to supply goods at an obvious or bona fide pricing, typographical or system error where enforcing the error would be unlawful or unreasonable.
Where payment has already been made, the customer may choose to proceed at the corrected price or receive a refund.
4.5 Quotations
Quotations are valid for the period stated on the quotation and remain subject to:
-
stock availability;
-
exchange-rate exposure where stated;
-
manufacturer price changes; and
-
any specific conditions contained in the quotation.
5. PAYMENT AND FRAUD PREVENTION
BuildVolume may offer payment by credit/debit card, electronic funds transfer, approved payment gateways, finance providers or other methods displayed at checkout or on a quotation.
Availability of a payment method does not oblige BuildVolume to accept a transaction that fails verification.
Card information may be processed by third-party payment service providers.
BuildVolume may conduct reasonable identity, payment and fraud checks before releasing goods.
Delivery or collection may be delayed while verification is completed.
6. VAT, IMPORT DUTIES AND INTERNATIONAL ORDERS
VAT is dealt with in accordance with South African tax legislation.
Customers receiving goods outside South Africa are responsible for destination-country:
-
import duties;
-
taxes;
-
customs charges;
-
permits;
-
certifications; and
-
import compliance,
unless BuildVolume expressly agrees otherwise in writing.
7. DELIVERY AND COLLECTION
7.1 Delivery Estimates
Dispatch and delivery dates are estimates unless BuildVolume expressly agrees to a fixed delivery date.
Any statutory rights arising from delayed or failed delivery remain unaffected.
7.2 Delivery Information
Customers are responsible for providing complete and accurate delivery information and suitable contact details.
Additional costs caused by incorrect addresses, failed delivery, restricted access or customer-requested redelivery may be charged where lawful.
7.3 Inspection on Delivery
Customers should inspect the external packaging when receiving goods and should note visible transit damage with the courier where reasonably possible.
Failure to do so does not remove statutory rights, but prompt reporting assists BuildVolume in pursuing courier claims.
7.4 Collections
A customer, representative or authorised courier collecting goods may be required to provide:
-
the relevant packing slip or order reference;
-
reasonable proof of identity; and/or
-
proof of authority to collect the order.
7.5 International Deliveries
International delivery times may be affected by customs, aviation capacity, border procedures and destination-country courier networks.
Such delays may be outside BuildVolume's reasonable control.
8. PRE-ORDERS AND SPECIAL ORDERS
8.1 Pre-Orders
Release dates and estimated arrival dates are based on information available from manufacturers, suppliers and logistics providers and may change.
BuildVolume will communicate material delays where reasonably possible.
Any statutory cancellation rights remain applicable.
8.2 Special and Custom Orders
Products sourced, configured, manufactured, personalised, activated, registered or specifically imported for a customer may have restricted cancellation or change-of-mind return rights to the extent permitted by law.
This does not remove rights relating to defective, unsafe or incorrectly supplied goods.
9. VOUCHERS, COUPONS AND PROMOTIONS
Gift vouchers and promotional coupons are subject to their stated conditions and applicable law.
A voucher will not expire earlier than permitted by the CPA.
Promotions may be subject to:
-
promotional dates;
-
qualifying products;
-
stock availability;
-
quantity limits; and
-
other advertised qualifying conditions.
BuildVolume may prevent duplicate redemption, misuse or abuse of promotional offers.
10. PRODUCT USE, COMPATIBILITY AND SAFETY
Customers are responsible for reviewing manufacturer specifications, system requirements, electrical requirements, material compatibility and safety instructions before using products.
Products such as 3D printers, laser equipment, CNC equipment, UV printers, scanners, resins and related equipment may require appropriate:
-
ventilation;
-
protective equipment;
-
supervision;
-
maintenance; and
-
controlled operating environments.
BuildVolume does not authorise unsafe or unlawful use of its products.
Third-party software, firmware, cloud services and manufacturer accounts may be subject to separate licence terms and privacy policies.
11. WARRANTIES AND DEFECTIVE PRODUCTS
Where the CPA applies, the statutory warranty of quality under section 56 applies in addition to any applicable manufacturer warranty.
Additional manufacturer warranties may differ according to brand, product and territory.
Manufacturer warranties supplement and do not unlawfully replace mandatory consumer rights.
Warranty coverage generally does not extend to problems caused by:
-
misuse or abuse;
-
unauthorised modifications or repairs;
-
accidental or liquid damage;
-
unsuitable consumables;
-
incorrect installation;
-
abnormal electrical supply;
-
normal wear and tear;
-
inadequate maintenance; or
-
operation contrary to manufacturer instructions,
except where applicable law provides otherwise.
BuildVolume may reasonably inspect and test returned products to establish the cause of a reported failure.
An inspection or diagnostic fee may only be charged where disclosed and lawful.

12. BUSINESS CUSTOMERS AND RESELLERS
Where the CPA does not apply to a Business Customer because of the nature of the transaction or the customer's juristic-person status or applicable asset threshold, the transaction will be governed by:

the applicable quotation;
-
approved credit terms;
-
reseller or dealer agreements;
-
manufacturer conditions; and
-
these Terms & Conditions.
Business Customers must inspect deliveries promptly and notify BuildVolume of shortages, visible damage or incorrect goods within a reasonable period.
Goods acquired for resale may also be subject to authorised reseller, territory, brand, warranty, marketing or support requirements communicated in writing.
Nothing in this section permits BuildVolume to contract out of legislation that applies compulsorily.
13. WEBSITE ACCOUNTS AND SECURITY
Users must not:
-
attempt unauthorised access to the Website;
-
introduce malicious software or code;
-
interfere with Website functionality;
-
impersonate another person;
-
use the Website for fraud or unlawful conduct; or
-
unlawfully scrape, reproduce or exploit protected content.
Customers are responsible for keeping their account credentials secure and should notify BuildVolume promptly if they suspect unauthorised access.
14. INTELLECTUAL PROPERTY
Website content, BuildVolume branding, original photography, graphics, designs, text, layout and other original material are protected by applicable intellectual-property legislation.
Manufacturer trademarks and intellectual property remain the property of their respective owners.
No licence is granted except the limited right to use the Website for lawful personal or business purchasing purposes.
15. LIMITATION OF LIABILITY
Nothing in these Terms excludes liability that cannot lawfully be excluded, including statutory liability arising under the CPA, ECTA or other mandatory legislation.
Subject to that qualification, BuildVolume will not be liable for indirect, consequential or special loss arising from:
-
Website downtime;
-
third-party systems;
-
customer misuse;
-
incompatible third-party products;
-
manufacturer cloud services; or
-
events beyond BuildVolume's reasonable control.
Any indemnity contained in these Terms applies only to the extent lawful and reasonable.
16. COMPLAINTS AND DISPUTES
Customers should first contact BuildVolume with:
-
their order or invoice number;
-
product serial number where relevant; and
-
a clear description of the issue.
BuildVolume will attempt to resolve complaints reasonably and in accordance with applicable law.
Nothing prevents a consumer from approaching the National Consumer Commission, an applicable consumer goods/services ombud, another competent regulatory body, court or tribunal where permitted by law.
17. PRIVACY
Personal information is processed in accordance with our Privacy Policy and POPIA.
18. CHANGES TO THESE TERMS
BuildVolume may update these Terms prospectively to reflect changes in legislation, business operations, technology or services.
Material changes will be published on the Website.
Changes will not retrospectively remove statutory rights that have already accrued.
19. GOVERNING LAW
These Terms are governed by the laws of the Republic of South Africa.
South African courts have jurisdiction, subject to any mandatory consumer forum or other lawful dispute mechanism.
